Privacy Policy
_Effective date: [insert date on publication]_
This Privacy Policy explains what information Home Charging Solutions, LLC collects through the Platform, why we collect it, who we share it with, and the choices you have. It applies to homechargingsolutions.com and the Home Charging Solutions application. It does not apply to the demonstration site at demo.homechargingsolutions.com, which uses frozen sample data and does not collect real personal information.
1. Information we collect
We collect information depending on your role in the marketplace.
From Dealers and their personnel:
- Business identity: dealership name, address, and business contact details.
- Account and user information: names, work email addresses, phone numbers, and login credentials of dealership staff who use the Platform.
- Prepayment and financial account information needed to fund and draw down the HCS account balance, and records of orders placed.
From Customers (the vehicle buyers):
- Contact information: name, email address, and phone number.
- Installation site address and details about the property relevant to the installation.
- Order and installation records, including status, scheduling, and completion information.
From Contractors (electricians):
- Business and personal identity: name, business name, contact details, and login credentials.
- Licensing and insurance information used to confirm eligibility to perform work.
- Tax and banking information, including the W-9 and the bank account details used to remit payouts.
- Job records: jobs accepted, work performed, completion documentation, and payout history.
From everyone, automatically:
- Technical and usage data such as IP address, device and browser type, pages viewed, and actions taken on the Platform.
- Cookies and similar technologies as described in Section 5.
- Error and performance diagnostics collected to keep the Platform reliable and secure.
> Bracketed review note: Collection of Contractor W-9 and banking data, and of Customer site addresses, carries specific data-security and tax obligations. An accountant should confirm the tax-form handling and retention, and an attorney should confirm the data-security representations, before this is published.
2. Why we collect it
We use the information above to:
- Create and administer accounts and authenticate users.
- Take Dealer prepayments, apply them to orders, and maintain account balances.
- Coordinate scheduling and dispatch so the assigned Contractor can complete installations at the correct site address.
- Confirm Contractor licensing and insurance, remit Contractor payouts, and meet tax reporting obligations.
- Communicate about orders, jobs, scheduling, and support, including by email and text message.
- Provide customer support during support hours and weekend on-call for active installs.
- Operate, secure, monitor, and improve the Platform, and detect and prevent fraud and abuse.
- Comply with legal, tax, and regulatory obligations.
We do not sell your personal information.
3. How data separation works
The Platform uses row-level security so that each user sees only the data appropriate to their role: a Dealer sees its own dealership, its own jobs, its own customers, and its own financials; a Contractor sees its own jobs plus the open job marketplace; HCS administrators see all data in order to operate the marketplace; and an unauthenticated visitor sees nothing. This separation is a core privacy control of the Platform.
4. Third-party processors we use
We share information with service providers that process data on our behalf so we can run the Platform. Each is used only for the purposes below, and each is bound by its own terms and data protection commitments. The processors we actually use are:
- Vercel - hosting and delivery of the website and application.
- Supabase - our database, where Platform records are stored (with the row-level security described above).
- Resend - sending transactional and notification emails.
- Twilio - sending SMS text messages (from +1 844-979-1161) for job and installation notifications.
- Square - processing payments, including Dealer prepayment and payment records.
- Cloudflare - security and network protection, including web application firewall, denial-of-service mitigation, and encrypted (Full strict SSL) delivery.
We may also disclose information when required by law, to enforce our Terms, to protect the rights, safety, or property of HCS or others, or in connection with a business transfer such as a financing, merger, or sale of assets.
> Bracketed review note: Each processor above should be covered by a data processing agreement, and the list should be kept current as the stack changes. Attorney review recommended, especially if any customers or contractors are located in jurisdictions with specific cross-border or consumer-privacy requirements.
5. Cookies, the gate, and similar technologies
We use cookies and similar technologies to keep you signed in, remember your session, operate the password gate, secure the Platform through Cloudflare, and understand how the Platform is used so we can improve it. Some of these are strictly necessary for the Platform and the gate to function, and the Platform cannot operate correctly without them. You can control non-essential cookies through your browser settings, though disabling cookies may prevent you from signing in or using core features.
6. Text messages and email
If you provide a phone number, you may receive SMS messages from +1 844-979-1161 about orders, scheduling, and active installs. Message and data rates may apply. You can opt out of non-essential text messages by replying STOP, though we may still send essential transactional messages needed to complete an active installation. You may opt out of non-essential emails using the unsubscribe option, while still receiving essential account and transaction emails.
> Bracketed review note: SMS consent and opt-out language should be reviewed against messaging-compliance requirements (for example carrier and A2P registration rules) by an attorney before publishing.
7. Data retention
We keep personal information for as long as your account is active and as long as needed to provide the services, and after that as needed to meet legal, tax, accounting, warranty, and dispute-resolution obligations. Financial and tax records, including Contractor W-9 and payout records and Dealer payment records, are retained for the periods required by applicable tax and accounting rules. When information is no longer needed, we take reasonable steps to delete or de-identify it.
> Bracketed review note: Specific retention periods, particularly for W-9 and payout records, should be set by an accountant to match tax-record requirements, and confirmed by an attorney. Do not state fixed periods until confirmed.
8. Data security
We use technical and organizational measures to protect information, including encrypted transport (SSL), the Cloudflare security layer, the password gate, role-based row-level security in our database, and restricted administrative access. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we become aware of a breach affecting your personal information, we will notify affected users and authorities as required by applicable law.
9. Your rights and choices
Depending on where you are located, you may have rights to:
- Access the personal information we hold about you.
- Request correction of inaccurate information.
- Request deletion of your information, subject to our legal, tax, and contractual retention obligations.
- Object to or restrict certain processing.
- Opt out of non-essential email and SMS communications.
To exercise any of these, contact us at [email protected] or 217-219-0228. We will verify your identity before acting on a request. Because HCS often holds a Customer's information on behalf of a Dealer, we may coordinate with the relevant Dealer to handle a Customer request.
> Bracketed review note: The exact rights, response timelines, and verification steps depend on which state and federal privacy laws apply to HCS's users. An attorney should confirm which regimes apply and tailor this section accordingly.
10. Children
The Platform is a business tool and is not directed to children. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, contact us and we will delete it.
11. Changes to this Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will revise the effective date above and, for material changes, provide notice through the Platform or by email. Continued use of the Platform after an update takes effect constitutes acceptance of the updated policy.
